PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR USING THIS WEBSITE OR ANY SERVICES PROVIDED BY I AM THE AGENT LTD, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS.
If you do not agree, you must not use our services.
TENANT FEES ACT 2019 (TENANT FEE BAN)
I Am The Agent Ltd operates in compliance with the Tenant Fees Act 2019. Information on permitted fees, prohibited fees, tenant protections and landlord obligations is available on our website and applies to all I Am The Agent advertised rental properties unless expressly stated otherwise.
We reserve the right to amend listing approval and compliance processes in order to meet legislative and regulatory requirements.
1.1 Account Registration
You must create an account using accurate, current and complete information. Accounts are personal, non transferable and may not be assigned without our prior written consent.
1.2 Fees and Pricing
Certain services are subject to payment. Prices displayed on the website at the time of purchase apply, plus VAT where applicable. We may amend pricing prospectively at any time.
1.3 Services Commence Immediately
All services commence immediately upon payment. This includes administrative processing, compliance checks, system setup, staff time and payment processing fees.
1.4 Cancellations and Refunds
A 24 hour cooling off period is offered as a goodwill gesture from the time payment is made.
After 24 hours no refund is guaranteed. Refunds are not an entitlement. Any refund provided after this time is entirely at the sole discretion of I Am The Agent Ltd and will be assessed on a case by case basis.
Refunds will not normally be considered where an incorrect package has been selected, where the user is an estate agent or letting agent, where identification or verification processes have started, where administrative or support work has taken place, where card processing or third party costs have been incurred, or where the cancellation is due to user error or a change of mind.
Selecting an incorrect package does not entitle the user to a refund.
1.5 ADMINISTRATION FEES AND IDENTIFICATION REQUIREMENTS
1.5.1 Incorrect Package Selection
If a property is listed by a user who is identified as an estate agent or letting agent and an incorrect package has been purchased, an administration fee of £15.00 including VAT will apply unless the order is cancelled in writing within 24 hours of payment or the package is upgraded to the correct agent package within 24 hours.
This administration fee is non refundable and covers compliance checks, account review and administrative handling. Selecting an incorrect package does not entitle the user to a refund.
1.5.2 Identification and Verification
Users are required to complete an identification and verification process. This will include identity verification, proof of ownership and anti money laundering checks.
Where the user is an estate agent or letting agent, additional verification is required. This will include director identification, confirmation of authority to act, and contractual documentation for each property being marketed, together with verification of the property owner’s identity.
Once the identification or verification process has been initiated, an administration fee of £15.00 including VAT will be charged if the process is not completed, fails, is rejected, or is not completed within the required timeframe. This fee is non refundable and applies whether or not the user proceeds with further services.
Failure to complete the required identification and verification checks will result in removal of the listing, suspension of the account, application of administration fees and forfeiture of any paid fees.
2.1 Service Availability
I Am The Agent Ltd may change, suspend or discontinue any part of the Service at any time without notice. No refunds or compensation shall be payable for interruption or modification of services.
2.2 Platform Disclaimer
I Am The Agent Ltd is a property marketing and advertising platform only. We do not guarantee enquiries, offers, sales, lets or outcomes. Users interact with the Service and each other at their own risk.
2.3 For Sale and To Let Boards
Boards are supplied subject to availability and delivery conditions. Once erected, liability rests entirely with the property owner. No third party or competing agent branding is permitted.
2.4 Advertising Periods
Advertising periods commence on listing activation and expire at the end of the advertised period or upon sale or let, whichever occurs first. Four weeks is 28 days and three months is 90 days including bank holidays, time under offer, withdrawn periods and verification delays.
2.5 Enquiry Limits and Listing Removal for Lettings
For lettings listings, enquiry levels are monitored to protect applicant experience and service quality. Where a lettings property receives 30 enquiries, I Am The Agent Ltd reserves the right to remove the listing from all marketing channels without notice.
Any decision to reinstate a listing removed due to enquiry volume is entirely at the discretion of I Am The Agent Ltd and may require changes to the listing, pricing, applicant criteria, or marketing approach. Reinstatement is not guaranteed.
I Am The Agent Ltd accepts no liability for listings removed as a result of high enquiry volumes, and no refunds, extensions or compensation will be provided in connection with such removal.
2.6 Developers and Commercial Listings
Developer packages are non refundable once the first listing is live. Unused credits expire after five years and are non refundable. Commercial listings are advertised via Rightmove PLC only.
You are responsible for providing accurate listing information, setting pricing, conducting viewings, responding to enquiries within 24 hours, complying with deposit protection laws and ensuring you have the legal right to market the property.
Listings must be for one whole property per listing unless a room by room package is purchased. Failure to comply may result in listing removal without refund.
You retain ownership of your content but grant I Am The Agent Ltd a royalty free licence to use it for the purposes of providing and promoting the Service. Photography and media created by I Am The Agent Ltd may not be used outside our platform.
Users must not misrepresent identity or authority, advertise third party services, include external links, upload misleading or unlawful content, or engage in abusive behaviour. Breaches may result in immediate account termination without refund.
Personal data is processed in accordance with our Privacy Policy.
Services are provided on an as is basis. Our maximum aggregate liability is limited to £400. We accept no liability for third party portals, external websites or user conduct. You agree to indemnify us against claims arising from your use of the Service.
We may suspend or terminate accounts for breach of these Terms, abusive behaviour, misrepresentation or failure to complete verification. No compensation shall be payable.
These Terms are governed by English law and disputes are subject to the exclusive jurisdiction of the English courts.
